Agreeing to these terms
These terms cover your use of the J&D Fayetteville Concrete and Masonry website and any estimate, quote or work you ask us for through it, by phone or in person. By using the site or booking work with us, you agree to them.
If you don't agree, please don't use the site. You can still call us at (910) 302-3425 with questions before you decide anything.
What we do
J&D Fayetteville Concrete and Masonry is a masonry contractor in Fayetteville, NC. We handle brick, block, stone and concrete work for homes in Fayetteville and the cities around it, and you can read more about our crew on our about page.
The descriptions on our home page and service pages explain the kind of work we do in general terms. They aren't a promise that a given method, material or result fits your house. That depends on what we find when we look at the job.
Estimates and pricing
We give free on-site estimates, and there's no pressure to book. An estimate is our best judgment of the work and cost based on what we can see and what you tell us at the time.
Masonry work can turn up things nobody could see before the job was opened, like a damaged footing, rotted framing behind a wall or soft soil under a slab. If that happens, we'll stop, show you what we found and explain the change in work and cost. We won't go ahead with the extra work until you approve it.
An estimate is good for the period written on it. After that, material prices and our schedule may have changed, so we may need to update it.
Scheduling and cancellation
Once you accept an estimate, we'll set a start date with you. Weather, curing time for mortar and concrete, material delivery and permit approvals can all move a schedule, so dates are our good-faith plan and not a guarantee.
If you need to cancel or reschedule, please call us as early as you can. If we've already ordered materials made or cut for your job, or started work, you may owe for those costs and the work done up to that point, as your written agreement spells out.
If we have to reschedule because of weather or something outside our control, we'll tell you as soon as we know and set a new date with you.
Payment
Your written estimate or agreement sets out what you'll pay, when payments are due and whether a deposit is needed before we start. Those written terms control for your job.
Final payment is due when the work is complete, unless your agreement says otherwise. If a payment is late, we may pause work until it's settled, and we may charge reasonable collection costs where North Carolina law allows.
Our guarantee and warranty limits
We're fully licensed and insured, and we stand behind our work with a satisfaction guarantee on every job. If something about the finished work isn't right, call us and we'll come look at it and make it right as your written agreement describes.
The guarantee covers our workmanship. It doesn't cover damage from things outside our control, such as settling of the ground, flooding, tree roots, vehicles, other contractors' work, lack of normal upkeep or changes someone else makes to the work later. Natural materials like brick and stone also vary in color and texture, and small hairline cracks in concrete are normal and aren't a defect.
Any manufacturer's warranty on materials comes from that manufacturer, and we'll pass along what we receive. Beyond what's written in your agreement, we make no other warranties, express or implied, to the extent the law allows.
Using this website
We try to keep the information on this site accurate and current, but it's offered as is, for general information only. It isn't engineering, legal or code advice for your property, and you shouldn't rely on it in place of an inspection.
The words, photos and design on this site belong to J&D Fayetteville Concrete and Masonry. Please don't copy or reuse them without our permission.
Limits on our liability
To the fullest extent North Carolina law allows, J&D Fayetteville Concrete and Masonry isn't liable for indirect, incidental or consequential losses, such as lost use of your property, from your use of this site or from our work. Our total liability on any job is limited to the amount you paid us for that job.
Nothing in these terms limits liability that the law doesn't allow us to limit, including liability for our own gross negligence or intentional wrongdoing.
Working out disagreements
If you have a problem with our work or a bill, call us first. Most issues get settled quickly once we're standing at the job together and can see what's going on.
If we can't settle it that way, we both agree to try in good faith to resolve it through mediation before going to court. Either of us may still bring a claim in small claims court if it qualifies there.
Governing law
These terms and any work we do are governed by the laws of the State of North Carolina. Any court case about them will be handled in the state or federal courts serving Cumberland County, North Carolina, unless the law requires otherwise.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one that applies. Changes won't alter the terms of a job you've already agreed to in writing.
If you have questions about these terms, call us at (910) 302-3425 or reach us through our contact page.
